RoadLoans “Win Kevin’s Ride” Sweepstakes
Official Rules
No purchase, loan application or loan draw necessary to enter or win. A purchase will not increase your chances of winning.
1. ELIGIBILITY. To enter the RoadLoans Win Kevin’s Ride Sweepstakes (the “Sweepstakes”), you must (a) be a lawful permanent resident of the United States or the District of Columbia; (b) be of legal age of majority in your jurisdiction of residence (and at least 18 years of age or older in the US) at the time of entry; and (c) have an active e-mail account and Internet access as of the beginning of the Sweepstakes Period. Residents who are physically located and residing in Alaska and Hawaii are not eligible to enter this Sweepstakes. This Sweepstakes is void in the excluded states identified herein, Puerto Rico, U.S. territories and possessions; outside of the U.S.; and where prohibited by law. This Sweepstakes and any website pages and advertisements relating thereto are intended for viewing only within the United States and District of Columbia. Employees, officers, directors and agents of Triad Financial Corporation, RoadLoans – A Division of Triad Financial Corporation (“Sponsor”), Kevin Harvick, Inc. and its parents, subsidiaries, affiliates, retailers and advertising or promotion agencies, including Promotion Group Central Inc. (“Sweepstakes Administrator”), and vendors involved in this Sweepstakes (collectively, “Sweepstakes Entities”), and the immediate family (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and household members of all such persons, whether or not related, are not eligible to participate in this Sweepstakes.
HOW TO ENTER. The Sweepstakes begins at 12:01 a.m. (Central Time (“CT”) on May 3, 2008, and ends at 11:59 p.m. CT on October 24, 2008 (“Sweepstakes Period”). ONLINE ENTRY: To enter online, go to www.roadloansracing.com, click the Sweepstakes icon, complete the online entry form and submit it in accordance with the on-screen directions during the Sweepstakes Period ("Online Entry"). Online Entries must be manually key-stroked; use of automated entry devices or programs is prohibited. If an entrant changes his/her Phone Number, E-mail Address or postal address after he/she enters the Sweepstakes, it is his/her sole responsibility to notify RoadLoans by (postal) mailing notice to RoadLoans' address, and such notice must be received by or before the end of the Sweepstakes Period. Limit one (1) Online Entry per person and e-mail address, per day. REFER-A-FRIEND: To earn additional Online Entries, enter up to five (5) unique and valid friends’ e-mail addresses into the fields/boxes where indicated, and click to submit (“Refer-a-Friend Entry”). Each person whom you refer will receive an e-mail solely notifying him/her about the Sweepstakes. You may only refer persons with whom you have an existing relationship. For each friend referral with a valid e-mail address, you will be given one (1) additional entry into the Sweepstakes, up to a maximum of five (5) entries. There is a limit of five (5) total Refer-a-Friend Entries per person for the entire Sweepstakes. Referring friend(s) is not a requirement for entry into the Sweepstakes. MAIL-IN ENTRY: To enter by mail without purchase, loan application completion, loan draw, or obligation, consumers may complete and mail, in accordance with the entry directions, a 3-1/2" x 5" postcard in a standard envelope with proper postage affixed to: Win Kevin’s Ride Sweepstakes Entry, P.O. BOX 5003, MELROSE PARK, IL 60161-5003 (“Mail-in Entry”). Information required on the Mail-in Entry form consists of your First Name, Last Name, Street Address (no P.O. Boxes), City, State, ZIP, Phone Number (including area code), and E-mail Address. Limit one (1) Mail-in Entry per person, per day. Each Mail-in Entry must be (a) postmarked no later than October 24, 2008; (b) received no later than October 29, 2008; (c) hand-printed; (d) completed in full; and (e) mailed in a separate, hand-addressed, postmarked, stamped outer envelope. ROADLOANS Car Show EVENT ENTRY: Consumers visiting any participating RoadLoans-sanctioned car show event at various malls and festivals that take place within the Sweepstakes Period (“Event”) can enter by validly completing an Official Sweepstakes entry at the Event (“Event Entry”). Limit one (1) Event Entry per person, per day. The dates, locations and all additional details associated with each Event are subject to change without notice. Online, Refer-a-Friend, Mail-In and Event Entries are collectively referred herein as “Entries.” With the exclusion of Refer-a-Friend Entry, each entrant may receive up to one (1) entry per day by any method or combination of methods of entry during the Sweepstakes Period. Refer-a-Friend entries will offer each entrant five (5) additional total entries for the Sweepstakes. All Entries become the property of Sponsor, and will not be acknowledged or returned. Sweepstakes Entities are not responsible or liable for Entries that are illegible, late, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged, incomplete, non-deliverable, misdirected, postage-due mail, or otherwise not in compliance with these Official Rules, and all such Entries will be disqualified. No photocopies or mechanical reproductions of Mail-in Entries permitted and all such Entries will be void.
2. PRIZE. One (1) Grand Prize:
One winner will receive one (1) Grand Prize (referred to herein as “Grand Prize”). The Grand Prize will be a customized Chevrolet Impala SS equipped with several upgrades (“Kevin’s Car”) as solely determined by Sponsor. Kevin’s Car will be driven and otherwise used by the Sponsor and its representatives for show and display as part of events as solely determined by the Sponsor. As a previously driven vehicle, the winner will not have a choice of the year, make, model, color, or features of Kevin’s Car and winner must agree to take delivery of Kevin’s Car “as is” and only those manufacturer’s warranties currently active at the time Kevin’s Car is delivered to the winner will apply. Other than any manufacturer’s warranty that may apply, no warranty or guarantee is either expressed or implied. Winner must take delivery of the vehicle from a location near the winner’s residence, as designated by the Sponsor, and within one the forty-eight (48) contiguous United States on or about February 28, 2009. Transportation fees shall apply and shall be the sole responsibility of the winner. All taxes, fees, expenses and other charges related to claiming and taking possession of the Grand Prize will be the sole responsibility of the winner including, but not limited to: federal, state and local sales, luxury and other taxes; preparation, destination and transportation charges; license, registration and title fees; insurance; fuel; and maintenance. Winner must be a licensed driver and must present proof of insurance and a valid driver's license upon acceptance of the vehicle. Approximate retail value (“ARV”) of Kevin’s Car is $29,000.00 (as of April 1, 2008). ARV does not include tax, title, license and destination/transportation charges and is the sole responsibility of the winner; winner shall be informed during the verification process of the amount of all other charges related to claiming and taking possession of the vehicle. The ARV may be adjusted at the time Kevin’s Car is delivered to the winner as determined by the Sponsor or its representatives.
Cash Prize Option: In lieu of Kevin’s Car to be awarded as the Grand Prize in the Sweepstakes, the Official Winner has an option, at their sole discretion, of receiving one (1) certified check in the amount of $15,000 payable to the Grand Prize winner (“Cash Option”). Should the Official Winner opt to receive the Cash Option as their sole prize choice, they will not receive any additional compensation, prize or award. ARV of Cash Option is $15,000.00. Winner would receive the Cash Option prize via FedEx approximately six (6) weeks after the conclusion of the Sweepstakes Period.
3. PRIZE RESTRICTIONS. Complete terms and conditions will be furnished with prize notification. Any difference between the stated ARV and actual value, if any, will not be awarded. No cash equivalent will be awarded and no substitution will be made except as provided herein at the Sponsors’ sole discretion. Sponsors reserve the right to substitute any listed prize or prize component for one of equal or grater value if the designated prize would become unavailable for any reason. Prize is non-transferable and are awarded "as is" with no warranty or guarantee either expressed or implied. Any depictions of the prize are for illustrative purposes only. Grand Prize Winner will be issued an IRS Tax Form 1099 stating the value of the prize for their 2008 or 2009 tax filing (determinate on the date on which the Grand Prize is awarded). Prize winner will be required to complete and furnish a W-9 Form, including his/her Social Security number, which will be used only for the purpose of reporting the winner’s prize earnings to the Internal Revenue Service as required by law. Odds of winning depend on the total number of eligible Entries received during the Sweepstakes Period.
4. DRAWING AND NOTIFICATION OF WINNER.
The potential Grand Prize winner will be selected in random drawings on or about October 30, 2008, by the Sweepstakes Administrator, an independent judging organization, whose decisions on all matters relating to the Sweepstakes will be final and binding. Potential winner will be notified by phone, e-mail, and/or Federal Express (at the phone number, e-mail address or address provided at the time of receiving entrant’s Entry) at the Sponsors’ sole discretion. Entrants need not be present at the drawing to win. If potential winner cannot be reached after a reasonable effort has been exerted; he/she is found to be ineligible; he/she cannot or does not comply with these Official Rules; and/or if his/her prize or prize notification is returned as undeliverable, potential winner will be disqualified, and an alternate potential winner will be selected at random from the remaining Entries. Potential winner will be required to sign, notarize and return an affidavit of eligibility and mutually acceptable liability release and publicity release (where permitted by law) within forty-eight (48) hours after notice is sent, or the prize will be forfeited in its entirety and an alternate winner will be selected.
5. SWEEPSTAKES CONDITIONS. This Sweepstakes is subject to these Official Rules and all applicable federal, state, provincial and local laws and regulations (collectively “Rules and Laws”). Notwithstanding anything to the contrary in Sponsor’s privacy policy available at www.roadloans.com/loans/content/rl/about_priv.jsp, as amended from time to time, and except where prohibited by law, winner’s acceptance of the prize constitutes permission of such participant for Sponsor and its designees to use, without notice, permission or further compensation, worldwide, and in perpetuity, in any and all forms of media, now known and hereafter devised, including, without limitation, on the Sponsor website, winner’s first name, last name, city and state, photograph, likeness, voice, and/or voice likeness for purposes of advertising, trade, promotion and publicity. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes; to be acting in violation of these Official Rules, or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; and all associated Entries will be void. CAUTION: ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, AND TO NOTIFY LAW ENFORCEMENT AUTHORITIES WHO MAY PURSUE CRIMINAL PROSECUTION. In the event Sponsor is prevented from continuing with this Sweepstakes (or any portion thereof), or the integrity and/or feasibility of the Sweepstakes (or any portion thereof) is undermined by any event or cause (each a “Force Majeure” event), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes without notice or further obligation. If the Sponsor, in its discretion, elects to abbreviate the Sweepstakes (or any portion thereof) as a result of a Force Majeure event, the Sponsor reserves the right, but shall have no obligation, to award the prize for the drawing at issue from among all non-suspect eligible Entries received for such drawing up to the time of such Force Majeure event.
6. LIMITATIONS OF LIABILITY. By submitting an Entry, each entrant agrees and acknowledges to be bound by the Rules and Laws, as well as the decisions of Sponsor and Sweepstakes Administrator, whose decision shall be binding and final; to waive any rights to claim ambiguity with the Rules and Laws, and that Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in Sweepstakes; acceptance/possession (including, but not limited to, delays by shipping companies), defects, and/or use/misuse of a prize; human error; incorrect or inaccurate transcription of Entry information; typographical, printing or other error in the printing of these Official Rules or in any Sweepstakes-related information; administration of the Sweepstakes, the processing of Entries or in the announcement of prize (including such error as may give an erroneous indication that a prize has been won); any technical malfunctions of the telephone network, computer online system, computer equipment, or software utilized by Sweepstakes; or any hardware or software compatibility problems on account of technical problems or human error, or combination thereof; any lost/delayed data transmissions, omissions, interruptions, defects; and/or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities. Each entrant further agrees to indemnify and hold harmless Sweepstakes Entities from any and all injuries, losses, damages, claims, actions or any liability resulting or arising from participation in this Sweepstakes or acceptance, possession or use of a prize, and to release all rights to bring any claim, action or proceeding against Sweepstakes Entities. Sweepstakes Entities shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of any of their agents, servants, employees or independent contractors; (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of a Sponsor; or (3) by any other cause, condition or event whatsoever beyond the control of Sponsor or its parents, subsidiaries and affiliated companies.
7. WINNERS LIST. To request names (first name and last initial) and addresses (city and state) of the winner (available after November 15, 2008), please send a self-addressed, stamped envelope postmarked by October 27, 2008 to: Win Kevin’s Ride Sweepstakes Winner List, P.O. Box 54-3355; Chicago, IL 60654-3355.
